These Terms of Service (“Terms”) govern access to and use of the GridShark.io platform, including all related applications, dashboards, APIs, and services (collectively, the “Platform”), operated by GridShark.io (“GridShark,” “Company,” “we,” “us,” or “our”).
By accessing or using the Platform, you agree to be bound by these Terms.
1. Use of the Platform
The Platform is intended for business and commercial use, including fleet tracking, geolocation reporting, and operational analytics.
You agree to:
- Use the Platform only for lawful business purposes
- Comply with all applicable laws and regulations
- Ensure that all users under your account are authorized
You may not:
- Reverse engineer or interfere with the Platform
- Use the Platform for unlawful tracking or surveillance
- Attempt unauthorized access to systems or data
2. Account Responsibility
You are responsible for:
- Maintaining account credentials
- All activity under your account
- Ensuring proper authorization for device and location tracking
GridShark is not liable for unauthorized access resulting from compromised credentials.
3. Location Data & Compliance
You acknowledge that:
- The Platform collects and processes geolocation data
- You are responsible for obtaining all necessary consents from employees, drivers, or third parties
- Use of tracking features must comply with applicable privacy and employment laws
4. Fees & Payment
If applicable:
- Fees are governed by your service agreement or contract
- Payments must be made in accordance with agreed terms
- GridShark reserves the right to suspend services for non-payment
5. Intellectual Property
All Platform content, software, and technology are owned by GridShark or its licensors.
You are granted a limited, non-exclusive, non-transferable license to use the Platform for business purposes.
6. Data & Privacy
Use of the Platform is subject to the GridShark Privacy Policy.
You retain ownership of your business data, but grant GridShark the right to process it for:
- Service delivery
- Analytics
- System improvement
7. Service Availability
GridShark does not guarantee uninterrupted service.
We may:
- Modify features
- Perform maintenance
- Suspend access when necessary
8. Limitation of Liability
To the maximum extent permitted by law:
GridShark shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Errors in location data or reporting
9. Indemnification
You agree to indemnify and hold harmless GridShark from claims arising from:
- Misuse of the Platform
- Violation of laws or regulations
- Unauthorized tracking or data collection
10. Termination
GridShark may suspend or terminate access:
- For violation of these Terms
- For legal or security reasons
- Upon termination of a service agreement
11. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
12. Changes to Terms
We may update these Terms at any time. Continued use constitutes acceptance of revised Terms.
